SC upholds death for rapist-killer of 2-year-old
A trial court in Jalna had found Ghumare guilty of kidnap, rape and murder of a two-year-old girl along with unnatural offence under IPC section 377 and awarded him death penalty. The Jalna trial court had relied on forensic evidence to convict the man. In January 2016, the Aurangabad bench of Bombay high court had upheld the death sentence.
But the three-judge bench of Justices Rohinton Nariman, Surya Kant and P Subhash Reddy were not unanimous when confirming the death sentence. Justices Nariman and Surya Kant, in a majority ruling, held that case merited death penalty while Justice Reddy dissented, observing that the convict was 25 years at the time and conviction was based solely on circumstantial evidence.
It added that the appellant was in his full senses and showed no remorse “for the gory crime.”
